Acceptable use policy for our servers

1. What is not allowed

Our servers must not be used for unlawful purposes. In particular, the following is prohibited:

• unlawful content and copyright infringements, e.g. distributing protected works without a licence
• fraud, phishing and distributing malware
• attacks on third-party systems, DDoS attacks, booter or stresser services and unauthorised port scans
• sending spam, open mail relays, crypto mining and sustained load that noticeably affects other customers

2. Your responsibility

You are responsible for the content and software on your server and must comply with applicable law and third-party rights.

If you use platforms such as FiveM, Minecraft or other services, their terms of use also apply.

On root servers you take care of the operating system, updates, firewall and credentials yourself (Section 4(3) GTC).

3. What happens in case of a violation

If there is a violation, we will first ask you to remedy it within a reasonable period.

Only if there is a serious risk to third parties, our infrastructure or other customers, an authority orders it, or serious criminal offences are involved, do we suspend immediately – and only as far and as long as necessary. We give reasons for every measure and you can lodge an appeal (magichosting.de/legal/einspruch).

Your statutory rights, including any right to a refund, remain unaffected. Details are set out in Sections 5(3) and 15 of our GTC.

4. Data backup

We back up virtual servers daily to separate storage in another data centre (Section 11 GTC).

Please still keep your own backups of important data outside our systems – our backups do not replace them.

Liability is governed exclusively by Section 12 of our GTC.

5. Data protection on your server

If you process other people's personal data on your server, you are responsible for doing so in compliance with the GDPR.

A data processing agreement (Art. 28 GDPR) is available on request (magichosting.de/avv).

6. Changes

We update this summary whenever our GTC change.

For existing contracts, changes to the GTC only apply in accordance with Section 20 GTC – i.e. generally only with your consent and with at least 4 weeks' notice in text form.
